Acceptance of Terms
By accessing or using the Easy Forklift Certification website and course, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our service. We may update these terms from time to time, and your continued use of the service after changes are posted constitutes acceptance of the updated terms.
Description of Service
Easy Forklift Certification provides online forklift operator training designed to meet the formal instruction requirements of OSHA standard 29 CFR 1910.178(l). Our service includes:
- Self-paced online training modules covering OSHA-required topics for powered industrial truck operation.
- A practice test and a final certification exam.
- A downloadable PDF certificate and printable wallet card upon successful completion of the exam.
- Employer verification documents and a hands-on evaluation checklist.
User Accounts
To access the course, you must create an account with a valid email address. You are responsible for:
- Providing accurate and truthful information during registration.
- Maintaining the security of your account credentials.
- All activity that occurs under your account.
You must not share your account with others or allow others to complete the course on your behalf. Doing so may invalidate your certification.
Payment and Refunds
The course fee is due at the time of enrollment. We accept major credit cards, debit cards, and PayPal. All prices are listed in US dollars.
We offer a full refund within 7 days of purchase if you have not completed the final exam and downloaded your certificate. Once you have downloaded your certificate, the purchase is non-refundable. See our refund policy for full details.
Employer accounts with invoice billing are subject to net-30 payment terms unless otherwise agreed in writing.
Certification Scope
This is important: our course covers the formal instruction (classroom) component of OSHA's forklift operator training requirements. It does not replace the hands-on practical evaluation that OSHA also requires.
Under 29 CFR 1910.178(l), forklift operator training must include three components:
- Formal instruction (lectures, written materials, videos) - this is what our course provides.
- Practical training (demonstrations and exercises) - your employer must provide this.
- Evaluation (operator demonstrates competence) - your employer must conduct this.
We provide hands-on evaluation checklists and documentation templates to help your employer complete steps 2 and 3, but it is the employer's responsibility to ensure these are carried out at the workplace.
Intellectual Property
All course content, including text, images, videos, quizzes, and materials, is owned by Easy Forklift Certification and protected by copyright. You may not copy, distribute, modify, or reproduce any course materials without our written permission. Your certificate and wallet card are for your personal and professional use only.
Limitation of Liability
Easy Forklift Certification provides training materials designed to meet OSHA's formal instruction requirements. To the maximum extent permitted by law:
- We are not liable for workplace accidents, injuries, or OSHA citations that occur after you complete our course.
- We are not liable for any employer's failure to complete the required hands-on evaluation.
- Our total liability for any claim related to our service is limited to the amount you paid for the course.
- We are not liable for indirect, incidental, special, or consequential damages.
Disclaimers
Easy Forklift Certification is an independent training provider. We are not affiliated with, endorsed by, or sponsored by OSHA, the U.S. Department of Labor, or any government agency.
Our course is designed to align with the requirements of 29 CFR 1910.178(l), but we cannot guarantee that every employer or OSHA inspector will accept our certification. Requirements can vary by workplace, industry, and jurisdiction.
The service is provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Governing Law
These Terms of Service are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these terms or your use of the service will be resolved in the state or federal courts located in Texas.
Changes to Terms
We reserve the right to modify these terms at any time. If we make material changes, we will notify you by email or by posting a notice on our website at least 30 days before the changes take effect. Your continued use of the service after the effective date constitutes acceptance of the updated terms.
